Assessments

The Board of Directors is empowered by the Deed Restrictions and the By-Laws of the Sand Creek Village Community Association to levy an annual assessment against each lot, parcel, apartment and commercial property in Sand Creek.  The monies received from the annual assessment is used to maintain the common areas of the village (entrance ways, pool and surrounding area, mosquito spraying, etc.)  The amount of the assessment is reviewed each year and adjusted if necessary.  The determination of the assessment amount is made on or before June 1st.   

The bill for the annual assessment is mailed to each Owner of record on or before June 1st and is due on or before July 1st.  Any assessments not paid on or before July 31st shall be deemed to be delinquent and will begin to accrue interest at a rate of 12% per annum, along with a $50 late fee.

Failure to Pay the Assessment

Within fifteen (15) days of the date that an annual assessment becomes delinquent, or by August 15th, the Board of Directors shall send (or cause to be sent) a past due notice to the Owner of the applicable property.

Within forty-five (45) days of the date that an annual assessment becomes delinquent, or by September 15th, the Board of Directors shall send (or cause to be sent) a letter to the Owner of the applicable property demanding payment of the delinquent assessment.  The letter shall be sent to the Owner at the last known mailing address of the Owner according to the books and records of the Association by certified mail, return receipt requested.

At any time after the annual assessment become delinquent, the Board of Directors may record (or cause to be recorded) a Notice of Unpaid Assessment to the Real Property Records of Harris County, Texas.  Recording a Notice of Unpaid Assessments is not necessary to secure the Association's lien; thus, recording a Notice of Unpaid Assessment is not a condition precedent to enforcing the Association's lien or taking other action to collect the delinquent assessment.  The Board of Directors shall have the discretion to record or not record a Notice of Unpaid Assessment as it deems necessary or appropriate.

If an annual assessment remains unpaid after the annual assessment for the following year has been billed and a past due notice and a certified demand for payment have been sent to the Owner, the delinquent account shall be forwarded to the Association's attorney for collection.
